As a hirer you may record this personal data.

Which personal data of temporary workers can you record as a hirer? This has been unclear since the introduction of the GDPR in 2018. This has now been clarified by the Dutch Data Protection Authority.  


According to the Dutch Data Protection Authority, it is necessary for hirers to include personal data in their administration in order to invoke mitigation of chain and hirer liability. The provision of personal data therefore falls under the 'legitimate interest' basis. The passing on of the citizen service number (BSN) has been regulated in the Implementing Regulation for the compulsory use of the citizen service number (BSN) since 1 January 2017, but this has not yet been the case for the other personal data.  


The data that a broadcaster is allowed to provide according to the AP:

  • name, address and place of residence     Which personal data can you record as a hirer?
  • date of birth
  • specification of the hours worked
  • nationality
  • type of ID, number and period of validity
  • If applicable: the presence of an A1 statement, residence permit, work permit or notification
