A new collective labor agreement for temporary workers

Actief Werkt! is a member of the ABU and our flex colleagues are therefore covered by the ABU collective labor agreement. Here you will find all the terms of employment as agreed between employers and trade unions. These are agreements on, for example, wages, allowances and allowances. In this previous news item we already explained that the ABU collective labor agreement and the NBBU collective labor agreement will be merged. The same rights and rules will apply to both collective agreements. These changes will come into effect on December 30. But what changes are involved?

1. Holiday pay

From 30 December 2019, the holiday allowance will be increased from 8% to 8.33%.

2. Holidays

All temporary workers are now entitled to 25 vacation days on the basis of full-time employment. All temporary workers of Actief Werkt! already received this. Nothing changes for them.  

3. Holidays

When are you eligible for a holiday allowance? The rules about this were quite complicated. These rules are now simpler and more favorable for all temporary workers. If it is not clear from the contract whether the public holiday falls on a working day, you will continue to be paid as a temporary worker if you have worked at least seven times on that day of the week thirteen weeks prior to the public holiday.  

4. Work-related travel hours

From now on, temporary agency workers will receive compensation for work-related travel hours or travel time, if the company where you work has such an arrangement.

5. Surcharge for physically demanding circumstances

The 'user company's remuneration' has been in existence since 2015. This means that as a temporary worker you are entitled to the same remuneration as permanent employees of a company. This includes:

  • The gross salary
  • ATV or ADV days (in time or money)
  • Surcharges for overtime and irregular hours such as shift work
  • Expense allowances (such as travel allowances)
  • Initial wage increases (these are the wage increases from the collective labor agreement)
  • Periodic wage increases (wage increases that are given for good performance)

 

From 1 September 2019, the allowance for working under physically taxing circumstances also falls under the hirer's remuneration, if the client has an arrangement for this for permanent employees. For example, you can think of an allowance for working under low or high temperatures or an allowance for dirty work.
