The unemployment benefit

It can happen. You are fired or resign. What are you doing now? Are you eligible for unemployment benefits and how do you ensure that everything is arranged for this?

 

Resign yourself

If you resign yourself, you are not entitled to unemployment benefits according to the law. You have chosen to stop working. They call this culpably unemployed.

 

UWV

If you are fired, you may be eligible for unemployment benefits (Unemployment Benefit). For this you must register with the UWV (Employee Insurance Benefits Agency) in your area or via www.werk.nl. Do this as soon as possible after your dismissal, from 1 week before your last working day, but at the latest within 1 week after your last working day.

 

Conditions for unemployment benefits

  • You are younger than the state pension age;
  • You are unemployed or have lost hours of at least 5 hours per week (if you work less than 10 hours per week, you must have lost at least half of your hours.
  • You are available for work;
  • You have worked for at least six months: in the 36 weeks before you became unemployed, you have worked at least 26 weeks;
  • You have not resigned yourself (in that case you are not culpably unemployed) and you were not fired for a serious reason;
  • You are insured for unemployment benefits.

 

Starting benefit

The UWV ensures that your resignation commences in accordance with the notice periods laid down in the law, the collective labor agreement or your contract. If you agree an earlier end date with your employer, for example if you both agree that dismissal will follow, your unemployment benefit will only start after the official notice period has expired.

 

How much

The UWV uses the average wage you earned in the 12 months before your dismissal to calculate your unemployment benefit. During the first two months of your benefit, you will receive 75% and then 70% of this calculated daily wage.

 

Terms

How long you are entitled to this benefit is determined by the period you worked before. For the first 10 years, you are entitled to 1 month of unemployment benefit per year worked. After that, you are entitled to half a month of unemployment benefits per year worked, with a maximum of 24 months.

 

Mutual agreement

You and your employer may decide together that it is better to leave. Then your employment will come to an end with 'mutual consent'. You record this in a 'settlement agreement.' This must show that the dismissal comes from the employer and that there is no reason for instant dismissal. You are usually entitled to unemployment benefits.
